BE IT ENACTED BY THE YOUTH LEGISLATURE OF THE STATE OF MINNESOTA YOUTH LEGISLATURE –
An act to
Restrict ICE in Minnesota
 
SECTION I - PURPOSE
The purpose of this bill is to restrict ICE’s power in the state of Minnesota and ensure that no ICE agent violates the
constitution or state law when carrying out their duties.
 
 
SECTION II - JUSTIFICATION
ICE has defied the constitution on many occasions and is routinely violating the civil rights of American citizens. ICE
has violated the fourth amendment, which protects Americans from unwarranted search and seizure, when they detained
Gerardo Gonzales without probable cause and flagged him for deportation. Gonzales was an American citizen. Additionally,
ICE agents have refused to identify themselves, wearing masks and driving unmarked trucks. Under the NDAA federal agents
are required to identify themselves. If an ICE agent were to break the law, there would be no way of holding them
accountable. Many times ICE has detained and even attempted to deport US citizens without due process, this violates the
fifth amendment, which ensures nobody shall be deprived of their freedom without due process in a court of law.
 
 
SECTION III - DEFINITIONS
False arrest is the unlawful restraint of detention of a person without legal authority or probable cause.
A gross misdemeanor is any crime not under the definition of a felony or misdemeanor
Improper arrest shall be defined as the arrest of a person while obscuring one's own identity.
 
 
SECTION IV - FUNDING
This is not a matter of raising taxes for a new project. It is a matter of upholding the laws that our country was built
upon. Particularly the 4th and 5th amendments of the constitution. We will demand that ICE agents identify themselves,
and will only cooperate with them if they have judicial warrants before entering schools, homes, businesses, or places
of worship. The state has the authority to do this, as under the 10th amendment the state cannot be coerced into federal
immigration law.
 
 
SECTION V – PENALTIES/ENFORCEMENT
While the state of Minnesota cannot sue ICE directly as they are a federal agency, we can charge ICE agents for breaking
the law. If a person is detained by an ICE agent without a judicial warrant or probable cause, the state can sue that
agent for false arrest. Imprison them for up to three years, and charge them a $5000 fine. If an agent provides false
identification, that is a gross misdemeanor and they shall be fined for $3000. If an ICE agent has no identification
whatsoever, when carrying out an arrest, this shall be considered improper arrest, and they will be imprisoned for no
more than one week and fined for up to $1000.
 
 
SECTION VI – EFFECTIVE DATE
This bill should be in effect by April 1st, 2026
