BE IT ENACTED BY THE YOUTH LEGISLATURE OF THE STATE OF MINNESOTA YOUTH LEGISLATURE –
An act to
Remove the Law Exception Where Somebody Underage Can Consume Alcohol in Their Parent or Guardian’s Home With Their
Parent or Guardian’s Consent
 
SECTION I - PURPOSE
This bill is essential to protect the minds and bodies of minors. Taking away the law's exception where a minor can
drink underage with the consent of their parent or guardian and in their parent or guardian's home is important because
when minors consume alcohol it can stunt brain development, put them in unhealthy situations such as an increased risk
of alcohol poisoning and loss of coordination, and can also put them and their parent or guardians in legal trouble.
Taking away this law exception will not only help the health of minors but it will help the underage drinking problem
Minnesota has.
 
SECTION II - JUSTIFICATION
In a study that took place in 2022, the data showed that in Minnesota 9.2% of 9th and 11th graders reported using
alcohol within the last 30 days of the study. Other studies show that 27.5% of underage drinking comes from parents. If
this bill gets passed it will significantly reduce the amount and normalization of underage drinking in minnesota.
 
 
SECTION III - DEFINITIONS
Exception- a thing, concept, or person that does not follow the rule.
Underage- a person under the legal drinking age
Consume- eat, drink, or ingest (food or drink)
Parent or guardian’s home- the residence where a child lives with a parent or a legally appointed guardian who has the
rights and responsibilities for the child's care and decisions
Parent or guardian’s consent- the legal permission given by a parent or legal guardian for a minor to participate in
activities like medical treatment, research, or contracts.
 
 
SECTION IV - FUNDING
Does not need any.
 
 
SECTION V – PENALTIES/ENFORCEMENT
For any minor who consumes alcohol include up to 90 days in jail and/or fines up to $1,000, consequences may also
include rehabilitation services, alcohol education, and community service.
Any parent/guardian who provides alcohol to a minor will be charged with a gross misdemeanor and could potentially spend
up to a year in jail and a 3,000 dollar fine. If the minor or minors face injuries or death as a result of the alcohol,
the parent/ guardian's penalties can escalate to a felony and/or more jail time.
 
 
SECTION VI – EFFECTIVE DATE
This act shall take effect on January 1st, 2027
